TERMS OF USE

These Terms of Use (the "Agreement" or the "Offer") constitute a legally binding agreement between an individual using the Service ("User", "you") and the service provider specified in Section 13 ("Provider", "we", "us") regarding the use of the online service for symbolic hand analysis and other digital services available at https://chiromant.com/ and in related web and mobile applications (collectively, the "Service").

By registering an account, accessing or using the Service in any way, or by making a payment for any digital Services, you agree to be bound by this Agreement in full.

If you do not agree with any part of this Agreement, you must not use the Service.

1. Parties and Provider Details

1.2. User

means any natural person or authorized representative of a legal entity who accepts this Agreement and uses the Service.

2. Definitions

2.1. Service

– a set of software and technical tools (website, mobile applications, server-side components) owned or controlled by the Provider, allowing Users to upload hand images and receive symbolic interpretations, written reports, self-reflection prompts and other digital content.

2.2. Services

– paid and free digital services provided through the Service, including but not limited to:

• generation of AI-assisted symbolic interpretations and written reports based on uploaded hand images;
• access to a personal account and archive of previous reports;
• access to additional features and content specified in the applicable plans and on the Service pages.

2.3. Subscription

– recurring access to certain paid features of the Service for a specified period and price, as described in the relevant plan.

2.4. Disclaimer

– a separate document describing limitations of the Service and clarifying that all content is for self-discovery, inspiration and entertainment only, not professional advice, available at https://chiromant.com/disclaimer-int, and forming an integral part of this Agreement.

2.5. Personal Account

– a protected section of the Service available to the User after authentication.

3. Subject of the Agreement

3.1.

The Provider grants the User access to the Service and the digital Services offered through it, and the User agrees to use the Service in accordance with this Agreement and, where applicable, to pay for paid Services.

3.2.

Services are provided remotely in the form of digital content. No physical goods are delivered.

3.3.

By paying for any Services and/or continuing to use the Service, the User acknowledges and accepts this Agreement, the Disclaimer and any applicable pricing and plan descriptions.

4. Registration and Access

4.1.

To use certain features of the Service, the User may be required to create an account and provide accurate and complete information (such as a valid email address).

4.2.

The User is responsible for maintaining the confidentiality of login credentials and for all activities that occur under the User's account.

4.3.

The Provider may suspend or terminate access to the Service if the User violates this Agreement, applicable law or the rights of third parties.

5. Services, Pricing and Payments

5.1.

The current list of Services, features, pricing and Subscription terms is available on the website at https://chiromant.com/pricing (or another relevant page).

5.2.

Prices are indicated in the relevant currency and may include or exclude taxes and fees, depending on the payment provider and applicable law. Final charges will be shown during checkout.

5.3.

Payments are processed by third-party payment providers or merchants of record integrated with the Service. Available payment methods are listed during checkout. The Provider does not store complete payment card details on its own servers.

5.4. A Service is deemed rendered when:

• for one-time reports – access to the report is provided in the Personal Account and/or sent to the User's email address;
• for Subscriptions – access to the paid features is granted for the relevant billing period.

5.5.

Due to the digital nature of the Services, refunds may be limited. As a general rule, refunds are only possible in cases of:

• duplicate or erroneous charges caused by a technical error; or
• failure to provide access to the purchased Service due to a fault clearly attributable to the Provider.

Additional refund and cancellation rules may be specified in a separate "Refund and Cancellation Policy" section on the website, which forms part of this Agreement.

5.6.

When purchasing a Subscription, the User acknowledges that recurring charges may be applied automatically at the beginning of each billing period until the Subscription is cancelled in accordance with the instructions on the website or in the app.

6. User Obligations

6.1. The User agrees to:

• provide accurate information when registering and making payments;
• keep account credentials confidential;
• use the Service only in accordance with this Agreement and applicable law;
• refrain from any actions aimed at disrupting the normal operation of the Service (hacking, attacks, unauthorized access, etc.).

6.2. The User shall not:

• upload or transmit any content that is illegal, harmful, offensive, defamatory, pornographic, violent, extremist or otherwise objectionable;
• infringe the intellectual property or privacy rights of the Provider or any third party;
• attempt to reverse engineer, decompile or otherwise obtain the source code of the Service;
• present the interpretations provided by the Service as professional medical, psychological, legal or financial advice on behalf of the Provider.

7. Provider's Rights and Obligations

7.1. The Provider may:

• modify the functionality of the Service, list of Services and pricing, by publishing updated information on the website;
• temporarily suspend access to the Service for maintenance, upgrades or in case of technical issues;
• restrict or terminate the User's access to the Service in case of breach of this Agreement or applicable law.

7.2. The Provider shall:

• make reasonable efforts to ensure the operation of the Service, given its technical and organizational capabilities;
• process personal data in accordance with the applicable Privacy Policy and law;
• respond to User inquiries within a reasonable timeframe.

8. Limitation of Liability and Disclaimer Reference

8.1.

The User acknowledges and agrees that all interpretations, reports and other materials provided by the Service are purely symbolic, inspirational and for entertainment and self-discovery purposes only. They are not professional advice of any kind.

8.2. The Provider does not provide:

• medical services, diagnosis or treatment;
• psychological counseling or psychotherapy;
• legal advice or legal opinions;
• financial, investment or other professional advisory services.

8.3.

Further clarifications are set out in the Disclaimer available at https://chiromant.com/disclaimer-int, which forms an integral part of this Agreement. By using the Service, the User confirms that they have read and fully accept the Disclaimer.

8.4.

The User agrees to seek advice from licensed professionals on any matters related to health, mental well-being, law or finances, and to rely on their own judgment.

8.5. To the maximum extent permitted by applicable law, the Provider shall not be liable for:

• any decisions or actions taken by the User based on the interpretations or materials provided by the Service;
• any indirect, incidental, consequential or punitive damages, including loss of profit or data;
• any inability to use the Service due to reasons beyond the Provider's reasonable control (e.g. internet outages, hardware or software failures, payment provider issues, force majeure).

9. Intellectual Property

9.1.

All elements of the Service (including but not limited to software code, design, texts, logos, databases and other content), except for content uploaded by the User, are protected by intellectual property rights owned by the Provider or its partners.

9.2.

The User is granted a limited, non-exclusive, non-transferable, revocable license to use the Service and the resulting digital content for personal, non-commercial purposes only.

9.3.

Any copying, distribution, public display, resale, or other use of the Service content beyond personal use without the Provider's prior written consent is prohibited.

10. Personal Data

10.1.

The processing of the User's personal data is governed by the Privacy Policy, available at https://chiromant.com/privacy.

10.2.

By accepting this Agreement, the User consents to the processing of their personal data for the purposes of:

• providing the Services;
• improving the Service;
• complying with legal obligations.

11. Changes to the Agreement

11.1.

The Provider may amend this Agreement from time to time. The updated version will be published on the website with the date of the last update.

11.2.

Continued use of the Service after any changes to this Agreement constitutes the User's acceptance of the updated terms.

12. Governing Law and Dispute Resolution

12.1.

This Agreement and any disputes arising out of or in connection with it shall be governed by and construed in accordance with the laws of Georgia, without regard to its conflict of law rules.

12.2.

The parties shall use their best efforts to resolve any disputes amicably through negotiations and email correspondence.

12.3.

If no amicable solution is reached, any dispute shall be submitted to the competent courts of Georgia, unless mandatory consumer protection rules of the User's country provide otherwise.
